Terms of sale
1. GENERAL PROVISIONS
1.1. These Slept online store (hereinafter: e-shop) terms and conditions of sale (hereinafter: terms and conditions) apply When purchasing from the Slept online store from the internet address http://www.slept.eeThe seller of the goods is united beds OÜ (hereinafter: seller), address Tartu mnt. 56 Tallinn 10115, registry code 14855165, VAT number EE102223390, e-mail address slept@slept.eeThe terms and conditions apply to all legal relationships arising between all persons (hereinafter: customer) and the seller when purchasing goods through the Slept e-shop.
1.2. The Seller has the right to unilaterally amend and supplement the terms and conditions by publishing the new terms and conditions on the Internet address. https://www.slept.ee/muugitingimused/If the customer placed an order before the changes to the terms and conditions entered into force, the terms and conditions in effect at the time of placing the order will apply to the legal relationship between the customer and the seller.
1.3. The customer can save, print and, if necessary, reproduce the terms and conditions before making a purchase, and the customer agrees to the terms and conditions when making a purchase from the e-store.
1.4. In addition to the terms and conditions, the legislation in force in the Republic of Estonia applies to purchases made from the online store.
2. SUBMITTING AN ORDER
2.1. Orders can be placed in the Slept e-store as an anonymous customer.
2.2. The customer selects the desired goods from the e-store and submits the order.
2.3. The customer chooses the place of delivery of the order.
2.4. The customer places an order and pays for the goods based on the prepayment invoice sent by the seller. Before paying the invoice, the customer checks that the information provided in the invoice corresponds to the customer's actual request.
2.5. Upon receipt of the order and payment for the product, the seller will send the customer a confirmation and invoice by e-mail.
2.6. Orders placed in the online store are processed on business days (e.g. Mon-Fri 9:00-17:00). If the order is placed on a Friday after 2:00 p.m., the order will be processed the following Monday.
2.7. The sales contract between the Seller and the Customer shall enter into force upon receipt of the entire purchase amount paid by the Customer into the Seller's bank account.
2.8. The Seller will refund the customer for goods that cannot be completed within 3 working days at the latest.
3. PRICE OF GOODS, PAYMENT OPTIONS
3.1. All prices of goods sold in the Slept e-store are shown in euros and include 20% VAT.
3.2. The customer pays the full sales price and delivery fee for the order as an advance payment. Payment is made outside the e-store based on an invoice.
3.3. A service fee may be added to the cost of the order in accordance with the agreement concluded between the customer and the bank or credit card issuer.
3.4. The online store reserves the right to make changes to sales prices.
4. DELIVERY CONDITIONS
4.1 Goods can be ordered to various parcel machines (small packages) or to the address indicated by the customer using a courier service (large-volume products).
4.1.1. The price of the goods includes a delivery fee, unless otherwise stated.
4.1.2. The customer must ensure that the goods are received at the agreed time and address. If the customer is not available at the time of arrival of the goods, the courier will make one additional attempt to deliver the goods. If both attempts to deliver the goods to the customer fail, the seller will consider that the customer has canceled the order and will return the purchase amount to the customer, including the delivery fee, immediately, but no later than within 14 calendar days, to the same bank account from which the purchase was paid.
4.2. Inspection of goods
4.2.1. Upon receipt of the goods, the customer undertakes to open the product packaging carefully, without damaging the packaging and products. If the customer has damaged the packaging due to negligence, i.e. the product packaging could have been opened without damaging it, the seller has the right to demand compensation for the damage caused when returning the goods. If the product packaging cannot be opened without damaging/breaking, the customer is not responsible for the damaged packaging.
4.2.2. If the customer discovers upon receipt of the goods that they have been sent the wrong or defective goods or the goods do not reach the customer in good condition and in a sealed package, the seller's customer service must be immediately notified at slept@slept.ee.
4.2.3. The Seller is responsible for the goods purchased by the Customer during their transportation. From the moment of receipt of the goods, the risk of damage or loss of the goods passes to the Customer.
5. PROCESSING OF CUSTOMER PERSONAL DATA
5.1. The Seller uses the personal data provided by the Customer and data on purchases made in accordance with the Personal Data Protection Act to the extent necessary to fulfill the order placed by the Customer in the online store. The Seller does not transfer the Customer's personal data to third parties, except to an undertaking providing postal or courier services to the extent necessary to deliver the goods to the Customer.
5.2. The customer has the right to prohibit the collection and use of his/her personal data at any time, unless it is necessary to collect a claim arising from the contract or to deliver the goods.
5.3. The use of electronic personal data for direct mailing only occurs if the customer has given separate consent for this on the slept.ee website.
5.4. The seller does not have access to the customer's bank details when paying for goods via online banking.
6. RETURN OF GOODS, WITHDRAWAL FROM THE CONTRACT AND REFUNDS
6.1. The customer has the right to withdraw from the contract without giving a reason within 14 calendar days from the date of receipt of the goods.
6.2. To return the goods, the customer must send a request for withdrawal using form here or to the address slept@slept.ee
6.3. When exercising the right of withdrawal, the customer is obliged to return the goods to the seller no later than 14 days from the date of submission of the withdrawal application.
6.4. In order to avoid compensation for the decrease in the value of the goods, it must be ensured that the goods are equivalent to new and that the goods have only been used for the purpose of testing and examining the suitability of the goods. In the process, it must be ensured that the condition of the goods and their packaging is not deteriorated. The goods are deemed to have been used in another way and thus to have deteriorated if the expected selling price of the goods, if sold under the same conditions, would no longer be the same as that of an equivalent new goods sold by the same e-store, but would be lower. The direct costs associated with the return are borne by the customer. We recommend returning the goods in the original transport packaging.
6.5. Returns are only accepted with a completed withdrawal form.
6.6. If the customer has withdrawn from the transaction, the seller will refund the purchase amount to the customer immediately, but no later than within 14 calendar days from the date of receipt of the withdrawal application by the seller. The refund will be made to the same bank account from which the purchase was paid.
6.7. If the customer has damaged or destroyed the returned goods intentionally or through negligence, the seller has the right to refuse to take back the goods or demand compensation for the damage caused.
7. SUBMISSION OF CLAIMS AND LIABILITY
7.1. The seller is liable for any non-conformity of the purchased goods within 2 years from the date of delivery of the goods to the customer. In the case of selling goods to a consumer, it is assumed that the non-conformity with the terms of the contract that has become apparent within 1 year from the date of delivery of the goods to the customer existed at the time of delivery of the goods, unless such an assumption is contrary to the nature of the goods or the defect. The customer undertakes to inform the seller of the non-conformity of the goods no later than 2 months from its discovery, i.e. to file a claim.
7.2. The customer is recommended to submit a claim by e-mail to slept@slept.ee or in writing by post to united beds OÜ Tartu mnt. 56 Tallinn 10115 or using the feedback form on the website. The complaint must state the customer's name and contact details, the date of submission of the complaint, the defect in the goods and the content of the claim, and attach a document proving the purchase.
7.3. The seller will respond to the claim within 15 days.
7.4. The seller is not liable for any damage or any other consequences arising from incorrect data provided by the customer when fulfilling the order, including any delay in delivery, if this is due to circumstances beyond the seller's control.
7.5. The seller is not liable for any damages resulting from the improper use of the ordered goods.
7.6. Disputes arising between the seller and the customer shall be resolved by the parties through negotiations. If an agreement is not reached, the customer has the right to contact the Consumer Protection and Technical Surveillance Authority (Endla 10A, 10122 Tallinn, https://ttja.ee) and the Consumer Disputes Commission (Endla 10A, 10122 Tallinn, https://ttja.ee/tarbijavaidluste-komisjon) for out-of-court settlement of the dispute or to Harju County Court. In addition, the European Union's electronic environment for resolving complaints with e-traders is open to all customers at the ODR platform (Online Dispute Resolution) at http://ec.europa.eu/odr.
