Terms of sale

 

1. GENERAL PROVISIONS

1.1. These sales terms and conditions (hereinafter: terms) of the online store of Slept (hereinafter: online store) apply to purchases made from the online store of Slept at http://www.slept.ee. The seller of the goods is united beds OÜ (hereinafter: seller), located at Tartu mnt. 56, Tallinn 10115, registry code 14855165, VAT number EE102223390, email address slept@slept.ee. The terms apply to legal relationships arising between all customers (hereinafter: customer) and the seller in connection with purchasing goods through the online store of Slept.
1.2. The seller has the right to unilaterally amend and supplement the terms by publishing the new terms at https://www.slept.ee/muugitingimused/. If the customer placed an order before the amendments to the terms entered into force, the terms that were in effect at the time of placing the order shall apply to the legal relationship between the customer and the seller.
1.3. Before making a purchase, the customer has the option to save, print, and if necessary, reproduce the terms, and the customer agrees to the provisions set forth in the terms when making a purchase from the online store.
1.4. In addition to the terms, the laws of the Republic of Estonia apply to purchases made from the online store.

2. PLACING ORDERS

2.1. Orders can be placed in the online store of Slept anonymously.
2.2. The customer selects the desired products from the online store and places an order.
2.3. The customer selects the delivery location for the order.
2.4. The customer places the order and pays for the goods based on the advance invoice sent by the seller. Before paying the invoice, the customer verifies that the information provided in the invoice corresponds to the customer’s actual wish.
2.5. The seller sends the customer a confirmation and invoice by email regarding the order and payment for the product.
2.6. Orders placed in the online store are processed on business days (e.g., Mon-Fri 9:00-17:00). If an order is placed on a Friday after 14:00, the order will be processed the following Monday.
2.7. The sales contract between the seller and the customer comes into effect once the purchase amount is credited to the seller’s account.
2.8. The seller refunds the money to the customer for goods that cannot be assembled within 3 business days

3. PRODUCT PRICE, PAYMENT OPTIONS

3.1. All prices of goods sold in the online store of Slept are indicated in euros and include a 22% value-added tax.
3.2. The customer pays for the order as an advance payment of the full sales price of the goods and the delivery fee. Payment is made outside the online store based on an invoice.
3.3. Additional service charges may be added to the order amount according to the agreement between the customer and the debit or credit card issuer.
3.4. The online store reserves the right to make changes to the sales prices.

4. DELIVERY CONDITIONS

4.1. Goods can be ordered to various parcel terminals (small packages) or to the address indicated by the customer using courier services (large-sized products).
4.1.1. The delivery fee is added to the price of the goods, unless otherwise indicated.
4.1.2. The customer must ensure the receipt of the goods at the agreed time and address. If the customer is not available at the time of delivery, the courier will make one additional attempt to deliver the goods. If both attempts to deliver the goods to the customer fail, the seller considers that the customer has withdrawn from the order and refunds the purchase amount to the customer, including the delivery fee, without delay, but no later than within 14 calendar days to the same bank account from which the payment was made.
4.2. Inspection of Goods
4.2.1. Upon receipt of the goods, the customer must open the product packaging carefully without damaging the packaging or the products. If the customer has damaged the packaging due to negligence, meaning that it was possible to open the product packaging without damaging it, the seller has the right to demand compensation for the damage when returning the goods. If the product packaging cannot be opened without damage, the customer is not liable for the damaged packaging.
4.2.2. If the customer discovers upon receipt of the goods that incorrect or defective goods have been sent, or if the goods do not reach the customer in good condition and in sealed packaging, the customer must immediately inform the seller’s customer service at slept@slept.ee.
4.2.3. The seller is responsible for the goods purchased by the customer during their transport. The risk of damage or loss of the goods passes to the customer upon receipt of the goods.

5. PROCESSING OF PERSONAL DATA OF CUSTOMERS

5.1. The seller uses the personal data provided by the customer and data on completed purchases in accordance with the Personal Data Protection Act to the extent necessary to fulfill the order placed by the customer in the online store. The seller does not disclose the customer’s personal data to third parties, except to the postal or courier service provider to the extent necessary for the delivery of the goods to the customer.
5.2. The customer has the right to prohibit the collection and use of their personal data at any time, except when it is necessary for the collection of a claim arising from the contract or for the delivery of the goods.
5.3. The use of electronic personal data for direct marketing purposes only takes place if the customer has given separate consent for this on the slept.ee website.
5.4. The seller does not have access to the customer’s banking details when paying for goods via internet banking.

6. RETURN OF GOODS, WITHDRAWAL FROM THE CONTRACT, AND REFUNDS

6.1. The customer has the right to withdraw from the contract without giving a reason within 14 calendar days from the receipt of the goods.
6.2. To return the goods, the customer must send a notice of withdrawal to slept@slept.ee.
6.3. When exercising the right of withdrawal, the customer is obliged to return the goods to the seller no later than 14 days from the date of receiving the goods.
6.4. If the customer has removed the goods from the packaging, the customer may only exercise the right of withdrawal if the goods are equivalent to new and have been used only for the purpose of testing and familiarization with the goods. During this process, the condition of the goods and their packaging must not be deteriorated. Using the goods in any other way and therefore deteriorating the goods is considered misuse of the goods if their expected selling price would not be the same but lower compared to selling the same equivalent new goods by the online store. We recommend that the customer returned or delivered all goods they wish to return in one shipment. The customer bears the direct costs associated with returning the goods. We recommend returning the goods in the original transport packaging.
6.5. Returns will only be accepted with a completed withdrawal form.
6.6. If the customer has withdrawn from the transaction, the seller shall refund the purchase amount to the customer without delay, but no later than within 14 calendar days from the date of receiving the withdrawal notice. The refund shall be made to the same bank account from which the payment was made.
6.7. If the customer has intentionally or due to negligence damaged the goods to be returned, the seller has the right to refuse to accept the return of the goods or to demand compensation for the damage caused.

7. SUBMISSION OF CLAIMS AND LIABILITY

7.1. The seller is responsible for any non-conformity of the purchased goods for a period of 2 years from the transfer of the goods to the customer. In the case of selling goods to a consumer, it is presumed that any non-conformity with the terms of the contract that becomes apparent within 1 year from the date of transfer of the goods to the customer existed at the time of transfer, unless such presumption is incompatible with the nature of the goods or the defect. The customer commits to notifying the seller of any non-conformity of the goods within 2 months of discovering it by submitting a claim.
7.2. It is recommended that the customer submitted a claim via email to slept@slept.ee or in writing by post to united beds OÜ Tartu mnt. 56, Tallinn 10115, or by using the feedback form on the website. The claim must include the customer’s name and contact information, the date of submitting the claim, the defect found in the goods, the content of the claim, and proof of purchase.
7.3. The seller is not liable for any damage or other consequences resulting from incorrect data provided by the customer during order fulfillment, including delays in delivery, if such delays are due to circumstances beyond the control of the seller.
7.4. The seller is not responsible for damages resulting from the improper use of the ordered goods.
7.5. Disputes between the seller and the customer are resolved through negotiations between the parties. In the event of a failure to reach an agreement, the customer has the right to turn to the Consumer Protection and Technical Regulatory Authority (Endla 10A, 10122 Tallinn, https://ttja.ee) and the Consumer Disputes Committee (Endla 10A, 10122 Tallinn, https://ttja.ee/tarbijavaidluste-komisjon) for out-of-court settlement of the dispute, or to the Harju County Court. In addition, all customers have access to the European Union’s online ODR (Online Dispute Resolution) platform for resolving complaints against e-traders at http://ec.europa.eu/odr.
